LEGAL SEPARATION

The process of obtaining a “legal separation” is nearly identical to that of obtaining a “dissolution of marriage”. A party may opt to obtain a legal separation as an alternative to dissolution of marriage for many reasons including social, moral, spiritual, or religious beliefs which do not conform to the actual dissolving of the marriage. In instances where the parties are uncertain as to the future of the marriage but are simply not prepared to seek a final termination of it, a legal separation may be a suitable solution to provide for the division of property and the determination of custody without actually dissolving the marriage. The “legal separation” process can be as emotionally taxing as the process of obtaining a dissolution of marriage.
